Asylum Interview Prep Guide
The best way to prepare for an asylum interview is to review your Form I-589 carefully, know the facts of your claim, organize your evidence, and be ready to answer questions truthfully and clearly. USCIS conducts the interview under oath, and the asylum officer will ask about your application and your reasons for seeking protection.
If you are preparing for an asylum interview in Royal Oak or elsewhere in the Detroit area, Just Right Law can help. Our immigration attorneys in Royal Oak, MI, can review your I-589, identify possible inconsistencies, help organize your evidence, and prepare you for questions you may face.
Review Your Form I-589 Before Your Asylum Interview in Royal Oak, MI
Read your entire Form I-589 before the interview. Check your dates, addresses, family information, immigration history, and descriptions of the events that caused you to seek asylum. Don’t try to memorize every sentence. You should understand what you submitted and be able to explain the important facts in your own words.
Know the Facts Behind Your Asylum Claim
Be prepared to explain what happened, who harmed or threatened you, why you believe you were targeted, when the events occurred, and why you are scared of returning to your home country. Under 8 U.S.C. § 1158(b), an asylum applicant generally has the burden of establishing eligibility for asylum. The asylum officer may compare your answers with what you wrote in your I-589 and other evidence in the record. Your answers should therefore clearly explain the facts supporting your claim. If you don’t remember an exact date or detail, say so rather than guessing.
Organize Your Supporting Documents
Bring a copy of your Form I-589 and the documents and identification listed in your interview notice. You may also need evidence supporting your claim, such as identity documents, medical or police records, threatening messages, photographs, witness statements, or evidence supporting your country’s conditions. Keep everything organized so you can find a document quickly if the officer asks about it.
Arrange a Qualified Interpreter
If you can’t conduct the interview fluently in English, 8 C.F.R. § 208.9(g) generally requires you to provide a competent interpreter. The interpreter must meet USCIS requirements and can’t be your attorney, a witness testifying for you, or a certain other prohibited individual. Arrange the interpreter before the interview. Problems with interpretation can interfere with your ability to explain your claim accurately.
Prepare for Detailed Questions
The asylum officer may ask follow-up questions about information in your application. Be ready to discuss your experiences, threats, injuries, reports to authorities, attempts to relocate, and your fear of returning. The officer may also ask about information that appears inconsistent or incomplete. Take your time and answer the question asked. If you don’t understand a question, ask the officer or interpreter to repeat or clarify it.
Your Royal Oak, MI, Immigration Lawyer Can Attend the Asylum Interview
You have the right to have an attorney or other authorized representative with you at an affirmative asylum interview. Your lawyer can’t answer the questions for you, but can prepare you beforehand, help address procedural issues, and assist during the interview. USCIS also states that attorneys and accredited representatives must be physically present for affirmative asylum interviews at asylum offices, subject to limited exceptions.
Check Your Interview Notice Before Traveling
Michigan asylum cases are generally handled through the USCIS Chicago Asylum Office, but interviews may be scheduled at the Chicago office or another designated USCIS location, including a satellite interview location. Don’t assume your interview will take place in Royal Oak or Detroit. Follow the location, date, and time listed on your USCIS interview notice and confirm the office information before traveling.
